July 16 Meeting: Is the Rule of Law at Risk?

Many U.S. presidents have taken an expansive view of executive power. Andrew Jackson famously argued that no institution should stand between the presidency and the will of the people, as expressed by the popular vote. But many observers think that Donald Trump's vision of executive power outdoes even Jackson, to the point of undermining the constitutional principles of separation of power, democratic accountability, and rule of law.

The Northport Cracker Barrel will meet on July 16 for a discussion of the state of the rule of law in America, led by former Leelanau County Judge Marian Kromkowski. Meetings are held on the third Thursday of every month in the social room of Trinity Church, 103 N. Warren St, Northport. All community residents and visitors are welcome.

    As We the People prepare to celebrate the 250th year of our United States, we have moved beyond a constitutional crisis, a specific challenge to the constitutional order, into the state of a constitutional failure given we are experiencing a systemic breakdown under the abusive application of Unitary Executive Theory.

    Unitary Executive Theory represents a powerful force for executive centralization which actively undermines the carefully constructed balance of power in the U.S. Constitution.
    Furthermore, we all need to be aware of authoritarian breakthrough.
    Authoritarian breakthrough is the insidious process by which a democratic system is dismantled from within, often leveraging existing legal frameworks and norms to concentrate power, vis-a-vis, UET.

    This process directly leads to constitutional failure by systematically eroding checks and balances, politicizing institutions, and undermining the rule of law.
    While not a failed state, a successful authoritarian breakthrough creates a government that is less accountable, more prone to instability, and less capable of serving its citizens, thereby establishing conditions that could, over time, lead to the characteristics of a failed state.

    Most terrifying, there is a very high risk that we shall fail as a United States, as the federal government loses its ability to govern and provide for its citizens.

    We must have voter reform to give all eligible citizens a voice and educate them on the importance of their informed vote.

    Let’s all show up to keep our Constitutional Democratic Republic.
